Judges Weigh Arguments Over Teacher vs. Student Rights in Landmark Tenure Lawsuit

Last Thursday, a California appeals court heard arguments in Vergara vs. California. In 2014, a lower court judge ruled that job protections for teachers like tenure are so harmful to students that they violate children’s rights to an equitable education. That ruling is now being challenged by the state of California and teachers unions.

Josh Dunn and Martha Derthick analyzed the lower court ruling for EdNext here and considered why this issue was being resolved by a court rather than the legislature.
